
The review of Regulation 650/2012, in matters of succession: application assessment and proposals for amendments
The project is based on Article 82 of the instrument, which imposes on the European Commission the obligation to submit, by no later than 18 August 2025, a report on the application of the Regulation, identifying the practical problems that have arisen and, where appropriate, accompanied by suggestions for its amendment. By that date, the text will already have been applied for ten years and, although the established deadline may be extended slightly, for a project intended to run for four years, an additional year may be an opportunity for the review to find the project in full operation, and even for the results of the group's research-once presented in the relevant forums and disseminated through leading publications-to be taken into account when formulating institutional proposals for amendment.
In this regard, the project consists of two distinct parts. The first involves an assessment of the application of the instrument over the years it has been in force; and the second consists of examining proposals to be considered in the review of the articulated text, distinguishing between aspects that are not suitable for legislative improvement-since their correct application will always depend on the interpretative work of the courts-and those others that do deserve the attention of those responsible for reviewing the regulatory text.
